These Terms of Use (the “Terms of Use”) apply to the service of the society with limited liability "FiveRooms" (hereinafter – FiveRooms) - "The User Identification System".

PASSING THE IDENTIFICATION, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT PASS THE USER IDENTIFICATION.

FiveRooms reserves the right , at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the identification passes following the posting of changes will mean that you accept and agree to the changes.

TERMS AND DEFINITIONS
User is a person who pass the identification by the Service ABC in order to gain access to the web resource/web service in accordance with the Terms of Use procedure and has reached the age acceptable in accordance with the applicable legislation for acceptance of the Terms of Use with appropriate credentials and having activated by successive actions status, which implies: a) enter the number of the telephone owned by the User b) the user performing the call to confirm mobile phone number.
The User Identification System (the Service ABC, Аuthentication By Call) is a service, consisting of an aggregate of: (a) computer programs (software code running on a computer) and (b) information (Content) placed in them FiveRooms and/or Users.
The Identifying call is a call performed by the User's in order to confirm mobile phone number.

The TERMS of SERVICE ABC
FiveRooms is the owner of all rights of the ABC Service. FiveRooms provides access to the ABC Service to all stakeholders in accordance with the Terms of Use and the applicable legislation.

USER IDENTIFICATION IN THE SERVICE ABC
User identification in the Service ABC is a free, voluntary and takes place when you connect to web resources that are served by the company FiveRooms.
While passing identification by the Service ABC User provides FiveRooms with his own accurate and up to date mobile phone number. User authentication consists of the following steps: User enters his phone number, navigates to the page with the phone number of FiveRooms by which a User makes dial-up; after establishing connection, the dialer is automatically terminated by the system; the User device is granted access to the web resource.
The user is responsible for the accuracy, timeliness, completeness, and compliance with the applicable legislation of the information provided while identification and its purity from claims of third parties.
FiveRooms processes the personal data of the User when providing the User with access to web-based resources, including for the purpose of obtaining the User-personalized (targeted) advertising.
Privacy policy is freely available in the Internet at: https://authenticationbycall.com/rules/. FiveRooms takes all necessary measures to protect personal information from unauthorized access, alteration, disclosure or destruction. FiveRooms provides access to personal User data only to those employees, contractors and agents of FiveRooms who needs for this information in order to support functioning of the ABC Service and providing the User with access to use the ABC Service. FiveRooms may use User-provided information, including personal data, to ensure compliance with the requirements of the applicable legislation (including prevention and/or suppression of illicit and/or illegal actions of Users). Disclosure of User-provided information can be made only in accordance with the applicable legislation at the request of the court, law enforcement, and in other stipulated by the applicable legislation cases.
Reliable and true the mobile phone number, entered by the User, is necessary and sufficient detail for passing identification in Service ABC. The User should not transfer his own mobile phone number to third parties for the purpose of passing their identification in the Service ABC.
Any actions performed using a particular mobile phone number and identification call deemed to have been taken by the User. In case of unauthorized access of third parties to the mobile phone of User, User shall immediately notify FiveRooms by email or feedback form placed on the page https://authenticationbycall.com.
OBLIGATIONS OF THE USER IN THE SERVICE ABC
When using Service ABC, the User must:
- to comply with the provisions of applicable legislation, these Terms of Use and other special documents of FiveRooms;
- to provide when passing identification with reliable and relevant details (telephone number);
- to inform FiveRooms about unauthorized access to and/or unauthorized use of the mobile phone number of the User;
- do not grant access to other Users through the mobile phone number of User;
When using the Service ABC the User is prohibited from:
- to pass the identification as a User on behalf of or instead of another person ("false identification");
- to introduce other Users to the confusion about his identity, using the mobile number other identified User;
- to use the software and implement actions aimed at disrupting the normal operation of the Service ABC;
- to upload, store, publish, distribute and provide access or otherwise use viruses, Trojans and other malware;
- use without special permission of FiveRooms automated scripts (programs) for passing identification of ABC in the Service and/or interaction with the Service ABC and its functionality;
- by any method, including by means of deception, abuse of trust, hacking, trying to access the mobile phone number of another User;
- to make use of the ABC Service other than through the interface that is provided FiveRooms, with the exception of cases when such actions were directly allowed to the User in accordance with a separate agreement with the administration;
In case the User disagrees with these Terms of Use or its new versions, the User is obliged to refuse of passing through identification in the Service ABC.

INTELLECTUAL PROPERTY RIGHTS
Exclusive rights to the Content posted in the Service ABC.
All objects placed in the ABC Service, including design elements, text, graphics, illustrations, video, scripts, programs, music, sounds and other objects and their collections (hereinafter the “Content”) are subject to the exclusive rights of FiveRooms. The rights to these objects reserved.
Except for the cases established by these Terms of Use and applicable legislation, no Content may be copied (reproduced), processed, widespread, displayed in a frame, published, downloaded, transferred, sold or otherwise used in whole or in part without prior permission of the copyright holder, except when the copyright holder explicitly expressed its consent.

THE OPERATION OF THE SERVICE ABC AND THE RESPONSIBILITY FOR ITS USE
FiveRooms may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Service ABC.
FiveRooms reserves the right at any time to modify the design of ABC Service, the content, the functionality, modify or Supplement used scripts, software and other objects used or stored in the Service ABC, any server applications at any time with or without notice thereof.
FiveRooms is not responsible for the User's breach of these Terms of Use and reserves the right, in its sole discretion, as well as when receiving information from other Users or third parties of User's breach of these Terms of Use, to suspend, restrict or terminate a User's access to all or one of the accepted FiveRooms web/web services at any time without explanation or prior notice.
FiveRooms ensures operation and serviceability of the Service ABC and undertakes to promptly restore its performance in case of technical failures and interruptions. FiveRooms is not responsible for temporary failures and interruptions in the work of Service ABC and the resulting loss of information. FiveRooms is not responsible for any damage to User's computer or other person, mobile devices, any other equipment or software caused by or associated with downloading materials from the Internet after passing through the identity Service ABC.
FiveRooms has the right to dispose of statistical information related to the operation of the Service ABC, and User information to provide targeted display advertising information to different audiences Users of the Service ABC.
FiveRooms has the right to send the User information about the development of the Service ABC and its services as well as to advertise its own activity and the activities of partners FiveRooms.
Limitation of liability of FiveRooms:
Service ABC and its services, including all scripts, applications, content and design are provided "as is";
The user should observe safety precautions in the use of the Service ABC. FiveRooms strongly recommends using only licensed, including anti-virus, software;
Using Service ABC, the User is aware that after the passage of the identification, uses web-resources/web-services is at your own risk and is personally responsible for the consequences of use of these materials, including for damage it may cause to the user's computer or third parties, for loss of data or any other damage;
FiveRooms is not responsible for the actions of Users in the web/web services after passing the identification by the Service ABC.
GOVERNING LAW; DISPUTE RESOLUTION
You agree that all matters relating to your access to or use of the Service ABC, including all disputes, will be governed by the laws of the Russian Federation. You agree to the personal jurisdiction by and venue in the Arbitration court of Rostov region and Rostov regional court in Rostov-on-Don, and waive any objection to such jurisdiction or venue. In the event of any controversy or dispute between FiveRooms and you arising out of or in connection with your use of the Service ABC, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
